Special Statement on the 22nd anniversary of the 1990 election
Special Statement on The Anniversary of The 1990
Multi-Party Democratic General Elections
(1) The 1990 Elections which were a
landmark in the Burma political scene as a victory of the people is celebrating
its 22nd Anniversary. History can neither be erased, nor can it be
substituted, or ignored. The black mark that had stained the State Law &
Order Restoration Council (SLORC) which had refused to acknowledge the results
of the elections and convene the Parliament also followed the State Peace &
Development Council (SPDC) into history. Furthermore the current U Thein Sein
government, elected under the 2008 Constitution, is also tarred with this same
brush. As long as the present government and the Pyidaungsu Hluttaw do not
acknowledge the results of the 1990 elections in a practical manner this will
remain, and continue to be, a political problem waiting for solution.
(2) At the 1990 Elections there were
27 political parties who won more than 1 constituency and 6 independents. Out
of 485 constituencies, the National League for Democracy (NLD) won 392 seats.
The remaining 26 parties and independents won 93 seats. Before the 2010
Elections there were altogether 10 legally registered political parties. This
is the manifestation of the true aspirations of the whole populace of the
country. Therefore we are of the opinion that the onus to find a solution to
the 1990 Elections results with not only the current government in power and
the Pyidaungsu Hluttaw but also on the elected representatives who had received
the mandates from the general public and the then political parties.
(3) The Speaker of Pyidaungsu Hluttaw,
U Khin Aung Myint, spoke casually that the results of the 1990 Elections are
acknowledged. We cannot accept this statement as it was made without any sense
of responsibility and devoid of any practical measures and spoken outside of
the regular Hluttaw session. It is just another deception on the electorate,
the political parties concerned and also on the elected representatives.
(4) The current U Thein Sein
government is basically a government that inherited the Roadmap of the
SLORC/SPDC and no more but a quasi-military government. Based on the experience
of the on-going armed conflicts in the Kachin State and the rules and
regulations of the current sessions of the two houses of the Hluttaw- which are
convened under the provisions of the 2008 Constitution- we are of the opinion
that there still exist many constraints to change the clauses in the 2008
Constitution and transition to a truly democratic system.
(5) We acknowledge that changes are occurring
in both the political and economic arenas in Burma. But these changes are not
changes in essence and politically which not yet on the path to democracy. So
long as the clauses that do not conform to democratic norms in the Constitution
are not amended it cannot be said that Burma’s political scene had changed.
(6) We welcome the activities to bring
about ceasefire between the ethnic nationalities and the government and also
efforts to bring peace and tranquility to these areas. However, we also do not
believe that the current strategies of U Thein Sein government’s- (1) agreed to
ceasefire, (2) set up a political party, (3) contest the elections, (4) become
active in the current Hluttaw activities- a Hluttaw elected on the basis of the
2008 Constitution- are conducive to bring about genuine peace in the country or
will solve the remaining political problems. We are of the opinion that
political activities, both inside and outside of the Hluttaw, should be
conducted in mutual respect and recognition of each other to face the current
political situation in the country.
(7) To bring about national
reconciliation, internal peace and solution to all outstanding political
problems we are of the opinion that a National Convention should be convened to
comprehensively address the following:
1. Comprehensive ceasefire all over
the country
2. General Amnesty
3. Release of all remaining political
prisoners
4. Participation of all stakeholders
at this National Convention

ျမန္မာ့ဒီမိုကေရစီေခါင္းေဆာင္ ေဒၚေအာင္ဆန္းစုၾကည္ က ေျပာပါတယ္။
အဖဲြ႔ခ်ဳပ္ကိုုယ္စားလွယ္ေတြအေနနဲ႔ လက္ရိွ ဖဲြ႔စည္းပံုျပင္ဆင္ေရးကို
အေရးတႀကီး ႀကိဳးပမ္းသြားမွာျဖစ္ေပမယ့္လို႔ လႊတ္ေတာ္ထဲမွာ စစ္တပ္ရဲ႕
ေထာက္ခံမႈမပါဘဲနဲ႔ေတာ့ ဖဲြ႔စည္းပံု ျပင္ဆင္ေရး မျဖစ္ႏုိင္ေသးဘူးလို႔လည္း
ေျပာပါတယ္။ ဒီအေၾကာင္းကိုေတာ့ ကိုသားညြန္႔ဦးက တင္ျပေပးထားပါတယ္။
အေမရိကန္ျပည္ေထာင္စုကေန ျမန္မာႏို္င္ငံအေပၚ ပိတ္ဆို႔အေရးယူထားတာေတြကို ယာယီ႐ုပ္သိမ္းေပးဖို႔ အေမရိကန္ အထက္လႊတ္ေတာ္ အမတ္ ဂြ်န္မက္ကိန္းက ေျပာၾကားခဲ့တဲ့အေပၚမွာ သူ႔အေနနဲ႔ ကန္႔ကြက္ ဆန္႔က်င္ဖို႔မရိွဘူးလို႔ ေဒၚေအာင္ဆန္းစုၾကည္က ေျပာခဲ့တာပါ။ အဂၤါေန႔ မနက္ပိုင္းက အေမရိကန္ ျပည္ေထာင္စု သမၼတေဟာင္း ေဂ်ာ့ခ်္၊ ဒဗလ်ဴဘြတ္ရွ္ အမွတ္တရဌာနက ႀကီးမႉးက်င္းပခဲ့တဲ့ Acceleration of Human Freedom လို႔ ေခၚတဲ့ လူသားနဲ႔ လြတ္လပ္မႈအခြင့္အေရး အခမ္းအနားမွာ ျမန္မာ့ ဒီမိုကေရစီေခါင္းေဆာင္ ေဒၚေအာင္ဆန္းစုၾကည္က အင္တာနက္တဆင့္ ပါ၀င္ေဆြးေႏြးခဲ့ပါတယ္။ အဲဒီမွာ လက္ရိွ ျမန္မာႏို္င္ငံေရးနဲ႔ပတ္သက္လို႔ အေကာင္းျမင္လြန္းလို႔မရဘဲ သတိထားဖို႔လိုတဲ့ အေၾကာင္း ေျပာသြားတာပါ။
“အေမရိကန္ႏိုင္ငံသားေတြအေနနဲ႔ လက္ရွိအေျခအေနမွာ ဒဏ္ခတ္ပိတ္ဆို႔မႈေတြကို ဆုိင္းငံ့ေပးဖို႔ သင့္ေလ်ာ္တယ္လို႔ ယူဆရင္ က်မအေနနဲ႔ ဒါကို မကန္႔ကြက္လိုပါဘူး။ ဒါေပမယ့္ ဒီေနရာမွာ သတိထားဖို႔ က်မ ေထာက္ျပလိုပါတယ္။ လူေတြအေနနဲ႔ ျမန္မာႏိုင္ငံရဲ႕ ျပဳျပင္ေျပာင္းလဲမႈေတြ အေပၚ သိပ္ကို အေကာင္းျမင္လြန္းၾကတယ္လို႔ က်မအေနနဲ႔ တခါတေလ ခံစားမိပါတယ္။က်မတို႔အေနနဲ႔ မေမ့အပ္တာ ကေတာ့ ဒီမိုကေရစီေဖာ္ေဆာင္မႈဟာ ေနာက္ျပန္မဆုတ္ႏုိင္ဘူးလို႔ ေျပာလုိ႔ မရႏုိင္ဘူးဆိုတဲ့ အခ်က္ပါပဲ။ က်မလည္း ပြင့္ပြင့္လင္းလင္း ေျပာခဲ့ၿပီးပါၿပီ။ စစ္တပ္အေနနဲ႔ ဒီမိုကေရစီေဖာ္ေဆာင္ရာမွာ ေလးေလး နက္နက္နဲ႔ ထိထိေရာက္ေရာက္ ေဆာင္ရြက္သြားမယ္ဆိုတဲ့ သံဓိဌာန္ခုိင္မာစြာ မခ်မွတ္မခ်င္း က်မတို႔ အေနနဲ႔ ဒီမုိကေရစီေဖာ္ေဆာင္မႈကို ေနာက္ျပန္ဆုတ္လို႔ မရႏုိင္ဘူးဆိုတာကို ဘယ္ေတာ့မွ ေျပာႏုိင္မွာ မဟုတ္ပါဘူး။”
အေနာက္ႏိုင္ငံေတြက ျမန္မာႏိုင္ငံအေပၚ ခ်မွတ္ခဲ့တဲ့ အေရးယူပိတ္ဆို႔မႈေတြဟာ ရည္မွန္းခ်က္ကို ထိေရာက္ခဲ့တယ္လို႔ ေဒၚေအာင္ဆန္းစုၾကည္က ျမင္ပါတယ္။ ၂၀၁၀ ေရြးေကာက္ပဲြအၿပီး ပထမ ဆံုး ေခၚယူတဲ့လႊတ္ေတာ္အတြင္းမွာပဲ အေရးယူဒဏ္ခတ္မႈေတြ ႐ုပ္သိမ္းေရးအဆိုကို ပထမဆံုးတင္သြင္း အတည္ျပဳခဲ့တာကိုၾကည့္ရင္ အေရးယူမႈေတြ ထိေရာက္ခဲ့တယ္ ဆိုတာကို ေဒၚေအာင္ဆန္းစုၾကည္ က ေထာက္ျပပါတယ္။
အမ်ိဳးသားဒီမိုကေရစီအဖဲြ႔ခ်ဳပ္အေနနဲ႔ အခုလႊတ္ေတာ္ထဲမွာ ဖဲြ႔စည္းပံုျပင္ေရးကိစၥကို အေရးတႀကီး ႀကိဳးပမ္းမွာျဖစ္ေပမယ့္ အလ်င္စလိုေတာ့ ေဆာင္ရြက္ႏုိင္မယ့္အေျခအေန၊ အလားအလမွာ မရိွဘူး လို႔လည္း ေဒၚေအာင္ဆန္းစုၾကည္က ေျပာပါတယ္။
“က်မတို႔အေနနဲ႔ ဖဲြ႔စည္းပံုျပင္ဆင္ေရးကို အဦးဆံုးလုပ္ႏိုင္လိမ့္မယ္လို႔ေတာ့ မထင္ပါဘူး။ ဖဲြ႔စည္းပံု ျပင္ဖို႔ဆိုတာ လႊတ္ေတာ္ရဲ႕ ၇၅ ရာခိုင္ႏႈန္း ေထာက္ခံမွ ျဖစ္မွာပါ။ ဒီအထဲ ၂၅ ရာခိုင္ႏႈန္းက စစ္တပ္က ခန္႔ထားတဲ့ ကိုယ္စားလွယ္ေတြပါ။ ဒီေတာ့ ဖဲြ႔စည္းပံုျပင္ဖို႔ဆိုတာ စစ္တပ္ရဲ႕ ေထာက္ခံမႈ ပါမွ ရမွာပါ။ ဒါေၾကာင့္ ဖဲြ႔စည္းပံုျပင္ဖို႔ဆိုတာ ဦးဆံုးေတာ့ မျဖစ္ႏိုင္ပါဘူး။ ဒါေပမယ့္ ဖဲြ႔စည္းပံုျပင္ဆင္ေရးဟာ က်မတို႔ အေရးတႀကီး အေလးထားလုပ္ေဆာင္သြားမယ့္ကိစၥျဖစ္ပါတယ္။”
ႏိုင္ငံေရး အက်ဥ္းသားေတြနဲ႔ပတ္သက္လို႔လည္း ျမန္မာအစိုးရအေနနဲ႔ တကယ္တန္း ဒီမိုကေရစီေရး ေဖာ္ေဆာင္မယ္ဆိုရင္ ႏုိင္ငံေရး အက်ဥ္းသားအားလံုးကို လႊတ္ေပးရမွာျဖစ္တယ္လို႔ ေဒၚေအာင္ဆန္းစုၾကည္က ေျပာသြားပါတယ္။
“ၿပီးခဲ့တဲ့ ဇန္န၀ါရီလတုန္းက ႏုိင္ငံေရးအက်ဥ္းသားအေတာ္မ်ားမ်ား လြတ္လာပါတယ္။ ဒီ လႊတ္လိုက္သူေတြဟာ အမ်ိဳးသားဒီမိုကေရစီ အဖဲြ႔ခ်ဳပ္က တင္ျပထားတဲ့ စာရင္းမွာ ပါတဲ့သူေတြလို႔ ျပည္ထဲေရး၀န္ႀကီးက ေျပာခဲ့ပါတယ္။ ဒီ စာရင္းအတိုင္းေျပာမယ္ဆိုရင္ ႏိုင္ငံေရး အက်ဥ္းသား ၂၇၁ ဦး လြတ္ဖို႔ က်န္ေနပါေသးတယ္။ ဒီကိစၥနဲ႔ပတ္သက္လို႔ ျပည္ထဲေရး၀န္ႀကီးနဲ႔ ေျပာဆိုေနတာ ရိွပါတယ္။ ဒါနဲ႔ပတ္သက္လို႔ လည္း ထပ္ေဆြးေႏြးခ်င္ပါတယ္။ သူတို႔ေၾကညာသလို ဒီ စာရင္းအတိုင္း လႊတ္ေပးတယ္ဆိုရင္ေတာ့ က်န္ေနတဲ့ ၂၇၁ ဦးကို ဘာေၾကာင့္ လႊတ္မေပးေသးတာလဲဆိုတာ တရား၀င္ သိခ်င္ပါတယ္။ ျမန္မာႏို္င္ငံမွာ ဒီမိုကေရစီေရး ေဖာ္ေဆာင္မႈေတြလုပ္မယ္ဆိုရင္ ႏိုင္ငံေရး အက်ဥ္းသားေတြ လံုးလံုးမရိွသင့္ပါဘူး။”
တိုင္းရင္းသားလူနည္းစုအေရးကိစၥနဲ႔ပတ္သက္လို႔ေတာ့ တိုင္းရင္းသားလူမ်ိဳးေတြနဲ႔ ႏိုင္ငံေရးအရ အေျဖထုတ္ႏိုင္မွသာ တိုင္းရင္းသားေဒသ ဖံြၿဖိဳးေရးလုပ္ငန္းေတြကို ေဆာင္ရြက္ႏိုင္လိမ့္မယ္ လို႔ ေဒၚေအာင္ဆန္းစုၾကည္က ေျပာသြားပါတယ္။
“အပစ္အခတ္ရပ္စဲေရး လုပ္႐ံုတင္ မလံုေလာက္ပါဘူး။ အပစ္အခတ္ရပ္စဲေရးဆိုတာ အစ သက္သက္ပါ။ ႏိုင္ငံေရးအရ အေျဖရွာမႈမ်ိဳး မရိွေသးပါဘူး။ ဒီအေျခအေနနဲ႔ တိုင္းရင္းသား လူနည္းစုေဒသေတြမွာ စီးပြားေရးဖ႔ံြၿဖိဳးမႈလုပ္ဖို႔ မလံုေလာက္ပါဘူး။ ဒါေၾကာင့္ ႏိုင္ငံေရးအရ အေျဖထုတ္ႏိုင္ဖို႔ လိုအပ္ပါတယ္။”
၀ါရွင္တန္မွာ အဂၤါေန႔လုပ္တဲ့ အဲဒီအခမ္းအနားမွာေတာ့ သမၼတ ကေတာ္ေဟာင္း ေလာ္ရာ ဘြတ္ရ္ွ က ေဒၚေအာင္ဆန္းစုၾကည္ကို တကမၻာလံုးက ေလးစားရတဲ့ ဒီမိုကေရစီနဲ႔ လူ႔အခြင့္အေရးေခါင္းေဆာင္ တဦးအျဖစ္ မိတ္ဆက္ေပးပါတယ္။ အဲဒီေနာက္ ၀ါရွင္တန္ပို႔စ္ သတင္းစာႀကီးရဲ႕ ပင္တိုင္ေဆာင္းပါးရွင္ မိုက္ကယ္ ဂီယာ ဂါစင္က ပရိသတ္ကိုယ္စားလွယ္ ေမးျမန္းခဲ့ ရာမွာ ေဒၚေအာင္ဆန္းစုၾကည္က အခုလို ေျဖၾကားသြားတာေတြ ျဖစ္ပါတယ္။

In Myanmar, what a difference an oath makes

-- Myanmar opposition leader Aung San Suu Kyi said Thursday that her
party members' refusals to take their seats in parliament to protest the
wording of the 2008 constitution were based on nothing more than a
"technical" obstacle.
"In
regard to the obstacles in the way of taking our places in the National
Assembly, we would like to think that these are purely technical ones,"
she told reporters at her residence in Yangon. "We would not like to
expand them to the point they become a political issue ... and we would
still seek to work in collaboration with the government, particularly
because we believe that (President) U Thein Sein is sincere in his
reform efforts and that he would truly like to see Burma a progressive,
prosperous nation."
Suu
Kyi cited "inconsistencies" in the wording of the constitution and in
election law and party regulations. "This is why this is a technical
matter," she said. "There have to be consistencies when it comes to
law."
She predicted that the nation will face difficulties, but said, "We'll just have to get over them."
Suu
Kyi's comments came three days after she and other members of her party
delayed their parliamentary debuts in an attempt to change the oath
that lawmakers must take.
Her
party, the National League for Democracy, asked the authorities to
adjust the wording of the oath to say that parliamentarians will "abide
by" the constitution rather than "protect" it.
"We want to change that constitution because it's not a democratic constitution," Ohn Kyaing, a spokesman for the party, said Sunday.

The constitution assigns 25% of parliamentary seats to unelected members of the military establishment.
On
Monday, the European Union suspended most of the sanctions it had
imposed on the country, citing the "transparent and credible" election
that brought Suu Kyi to office and other reforms.
Suu
Kyi and 42 other candidates from her party, the National League for
Democracy, won seats in by-elections on April 1, a result welcomed by
the United States and Britain as a sign of progress toward democracy in
Myanmar after decades of repressive military rule.
After
the elections, Suu Kyi and other newly elected opposition members were
invited to attend the session of parliament this week in the capital,
Naypidaw.
But they demurred, requesting instead that the wording of the lawmakers' oath be changed first.
The
tension over the oath marks the first public sign of conflict between
the opposition and the reformist government of President Thein Sein
since the by-elections.
Tin Oo, a senior party official, said that Thein Sein had agreed before the elections to amend the oath.
"Whether
Ms. Aung San Suu Kyi enters parliament or not is her decision," the
president said Monday. "She has to decide it. The parliament is all in
favor of her entrance and very welcoming of her."
The
decision by the European Union to suspend most of its sanctions against
Myanmar came Monday at the foreign ministers' meeting in Luxembourg.
Only a ban on arms exports continues, according to the EU.
EU
sanctions against Myanmar, first imposed in 1996, have included limits
on diplomatic contacts and non-humanitarian aid and development
programs, a freeze on the offshore accounts of Myanmar officials and
visa restrictions.
Still,
an expert stressed it will take time for the easing of sanctions to
affect the people of Myanmar, about a third of whom were living in
poverty in 2007, according to the CIA World Factbook.
"On
the day-to-day basis, nothing will change for the average person on the
streets," said Tony Picon, associate director at Colliers
International, a real estate company. "These things take time."
Myanmar's
authoritarian military rulers have begun loosening their grip on power
after decades during which dissent was stifled and freedoms severely
limited.
In
the past 12 months, the government has pardoned hundreds of political
prisoners, secured a ceasefire with Karen rebels and agreed to negotiate
with other ethnic rebel groups.
Myanmar's
leaders have come a long way, but more work must be done, the EU said
Monday in a statement. "The foundation for development is legitimate
government, the rule of law and national reconciliation," the statement
said. "The EU praises the peaceful nature of the process and the
readiness of the parties to work towards the same goals, with a shared
vision for political, social and economic reforms."
Western
governments have applauded this month's by-elections and the other
recent reforms by Thein Sein's government. The U.S. and Australian
governments eased some sanctions on Myanmar last week.
While
control of parliament will not change, despite the opposition's strong
performance, the result nonetheless gives the National League for
Democracy a notable presence.
Myanmar's
legislature has 664 seats, more than 80% of which are still held by
lawmakers aligned with the military-backed ruling party, the Union
Solidarity and Development Party.
Suu
Kyi led her party to a landslide victory in 1990, when Myanmar last
held multiparty elections. But the junta ignored the results and kept
her under house arrest.

NLD Stalling on Parliamentary Oath

The 43 prospective MPs from the National League for Democracy (NLD) may not take their seats in Parliament until the government changes the wording of the oath that MPs must swear by―in particular, the pledge that they must “protect the Constitution.”
NLD spokesperson and lawyer Nyan Win told The Irrawaddy on Tuesday that the party is awaiting a response from President Thein Sein to a letter that party leaders sent him regarding the oath.
The president is due to travel to Tokyo for a five-day visit at the end of the week, leading to fears that such an amendment may take time.
Nyan Win said that the party members “want to respect the law,” but that the wording was “unacceptable.” He also confirmed that the elected candidates will meet in Rangoon on April 19-20 to seek legal guidance and to discuss parliamentary strategy.
“They must change the oath, because they have already changed the law,” MP-elect Zeya Thaw told The Irrawaddy.
“We are not going to join [the Parliament] on the 23rd [April],” he said, adding that they would wait until the wording of the oath has been changed.
“Our party re-registered because they changed the law, and in our campaign we talked about the amendment procedure [of the constitution]. If we accept [the oath], we are lying to our people, thats why we cannot accept it,” Zeya Thaw said.
He explained that the NLD took part in the April 1 by-election because the government agreed to amend an election law that originally stated that parties must “abide by and protect” the constitution, but which was changed to read “abide by and respect.”
The oath, however, still states that MPs must “protect” the constitution. The NLD campaigned during the by-election on a platform which promised to fight for the amendment of non-democratic articles within the 2008 constitution.
The NLD has stated that it is committed to changing the constitution which guarantees that 25 percent of seats are reserved for the military, and that the military can seize power in a state of emergency without recourse to legal approval. To amend constitutional articles requires some 75 percent of approval in the parliament.
Zeya Thaw further stated that Dr. Myat Nyar Na Soe―their sole MP who currently sits in Parliament, having defected from the National Democratic Force (NDF)―would seek to press for the amendments in the Upper House.

The
Ministers welcomed recent positive developments in Burma/Myanmar, including
the April
1 parliamentary by-election, and other significant steps the Government of
Burma/Myanmar
has taken toward democratic reform and national reconciliation.
They
underlined their readiness to assist Burma/Myanmar in advancing reforms and
stressed
the need for the international community to support these efforts. The
Ministers
praised the opportunity for all opposition parties, including the National
League for
Democracy (NLD) led by Aung San Suu Kyi, to participate in the electoral
process;
progress toward preliminary ceasefires with armed ethnic groups; the
release of
a significant number of political prisoners; and measures to eliminate
forced
labor. The Ministers will consider the easing of sanctions to help this country
embed
reform and fully integrate into international and regional political and
economic
processes. At the same time, the Ministers called on the Government of
Burma/Myanmar
to continue reform and reconciliation efforts, and undertake the
unconditional
release of all remaining prisoners of conscience and the removal of
legal
conditions placed on those already released; further steps to end all violence
in
ethnic
minority areas; providing unfettered international humanitarian access to
conflict
zones and internally displaced persons; and severing of military ties with
North
Korea, in accordance with Burma/Myanmar’s international obligations
regarding non-proliferation.
